M\u0103surile restrictive impuse de Uniunea European\u0103 prin Pachetul de Mobilitate 1 au fost \u00eenc\u0103 de la bun \u00eenceput o amenin\u021bare, mai ales pentru firmele de transport mici \u0219i mijlocii afectate deja de contextul pandemic anterior.<\/p>\n\n\n\n<p>O reglementare legislativ\u0103 de acest gen venit\u0103 peste pre\u021bul combustibilului, timpii mari de a\u0219teptare \u00een vam\u0103, criza for\u021bei de munc\u0103, a fost un test de anduran\u021b\u0103 pentru mul\u021bi transportatori.<\/p>\n\n\n\n<p>Directiva Deta\u0219\u0103rii, Pachetul de Mobilitate 2022 au devenit subiecte dezb\u0103tute \u00eendelung at\u00e2t de speciali\u0219ti \u00een domeniu, juri\u0219ti \u0219i persoane implicate \u00een domeniul de transport. Totul a pornit de la o serie de ambiguit\u0103\u021bi legislative ce au l\u0103sat loc multor interpret\u0103ri.<\/p>\n\n\n\n<p>Pachet de Mobilitate 1 &#8211; Cum pot \u00eens\u0103 transportatorii s\u0103 \u201esupravie\u021buiasc\u0103\u201d noilor cerin\u021be legislative?<\/p>\n\n\n\n<p>\u00cen primul r\u00e2nd cunosc\u00e2nd \u0219i respect\u00e2nd normele \u00een vigoare.<\/p>\n\n\n\n<p>Pachetul de Mobilitate 1, ale c\u0103rui norme au fost implementate din 2 februarie 2022, vizeaz\u0103 companiile de transport rutier care efectueaz\u0103 opera\u021biuni de transport rutier interna\u021bional \u00een Spa\u021biul Economic European \u0219i \u00een Marea Britanie.<\/p>\n\n\n\n<p>Mai precis, \u0219oferii companiilor de transport care realizeaz\u0103 opera\u021biuni de cabotaj \u0219i cross-trade \u00een aceste zone, trebuie \u00eenregistra\u021bi \u00een cadrul platformei IMI (Sistemul de Informare al Pie\u021bei Interne).<\/p>\n\n\n\n<p>Ulterior, acestora le sunt emise certificate de deta\u0219are cu valabilitate de maximum 6 luni, pe care trebuie s\u0103 le de\u021bin\u0103 fie \u00een form\u0103 electronic\u0103, fie \u00een format fizic, pe h\u00e2rtie.<\/p>\n\n\n\n<p>Trebuie s\u0103 \u021binem cont de faptul c\u0103 Rom\u00e2nia se pozi\u021bioneaz\u0103 \u00een top 3 opera\u021biuni de transport rutier interna\u021bional de tip cross-trade (10,5%) \u0219i cabotaj (8,2%) \u00een Uniunea European\u0103, conform UNTRR.<\/p>\n\n\n\n<p><em>Cross-trade &#8211; opera\u021biune de transport efectuat\u0103 \u00eentre dou\u0103 state membre sau \u00eentre un stat membru \u0219i un stat ter\u021b. Aten\u021bie! transportatorii rom\u00e2ni \u0219i nu numai<\/strong><\/h3>\n\n\n\n<p>Transportatorii sunt obliga\u021bi s\u0103 asigure \u0219oferilor plata pentru fiecare or\u0103 lucrat\u0103 \u00een statele \u00een care efectueaz\u0103 opera\u021biuni de cabotaj \u0219i transport cross-trade.<\/p>\n\n\n\n<p>\u00cenainte de a efectua un serviciu de transport, firmele sunt obligate s\u0103 declare <a href=\"https:\/\/cargotrack.md\/ru\/detasare-soferi\/\">deta\u0219area \u0219oferilor \u00een platforma IMI<\/a>, creat\u0103 pentru acest scop.<\/p>\n\n\n\n<p>\u00cen plus, a fost introdus\u0103 obligativitatea introducerii manuale de c\u0103tre \u0219ofer \u00een tahograf intrarea \u0219i\/sau ie\u0219irea dintr-un anumit stat.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>21 februarie 2022 \u2013 \u00centoarcerea camioanelor acas\u0103, noi restric\u021bii<\/strong><\/h3>\n\n\n\n<p>Din aceast\u0103 dat\u0103 s-a introdus obligativitatea \u00eentoarcerii acas\u0103 a camioanelor la 8 s\u0103pt\u0103m\u00e2ni.<\/p>\n\n\n\n<p>Dup\u0103 trei opera\u021biuni de cabotaj \u00eentr-o \u021bar\u0103 timp de \u0219apte zile, urmeaz\u0103 perioada numit\u0103 \u201ecooling off\u201d de patru zile. &nbsp;Mai precis, dup\u0103 finalizarea opera\u021biunilor de cabotaj, nu se mai pot efectua astfel de ac\u021biuni cu acela\u0219i vehicul \u00een respectivul stat membru pentru o perioad\u0103 de patru zile ulterioar\u0103 \u00eencheierii opera\u021biunii sale de cabotaj din acea \u021bar\u0103.<\/p>\n\n\n\n<p>Excep\u021bie de la aplicarea legislativ\u0103 a Directivei Deta\u0219\u0103rii o fac transportul bilateral, tranzitul \u0219i opera\u021biunile de comer\u021b \u00eencruci\u0219at legat de fiecare sens dintr-un transport bilateral.<\/p>\n\n\n\n<p>Principalele efecte ale \u00eentoarcerii acas\u0103 la 8 s\u0103pt\u0103m\u00e2ni genereaz\u0103 \u00een primul r\u00e2nd infla\u021bie de transportatori \u0219i pre\u021buri mic\u0219orate. \u00cen plus, se dubleaz\u0103 num\u0103rul de camioane care fac import\/export.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>20 mai 2022 \u2013 obliga\u021bii \u00een func\u021bie de tonaj<\/strong><\/h3>\n\n\n\n<p>A fost integrat\u0103 <a href=\"https:\/\/cargotrack.md\/ru\/licenta-transport-2-5-3-5-tone\/\">necesitatea licen\u021bei de transport rutier<\/a> pentru vehiculele de peste 2,5 tone. Mai mult, companiile au fost obligate s\u0103 \u00eendeplineasc\u0103 cerin\u021ba de bun\u0103 reputa\u021bie \u0219i s\u0103 aib\u0103 angajat un manager de transport atestat \u00een acest scop.<\/p>\n\n\n\n<p>\u00cen plus, s-a implementat obliga\u021bia privind asigurarea unei garan\u021bii financiare pentru primul autovehicul de minimum 2,5 tone, \u00een valoare de 1800 de euro.<\/p>\n\n\n\n<p>De asemenea, vehiculele sub 3,5 tone sunt obligate s\u0103 foloseasc\u0103 tahograful.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>20 august 2022 \u2013 \u00centoarcerea \u0219oferilor acas\u0103<\/strong><\/h3>\n\n\n\n<p>\u0218oferii care lucreaz\u0103 \u00een comunitate sunt obliga\u021bi s\u0103 se \u00eentoarc\u0103 acas\u0103 sau la sediul companiei, la fiecare patru s\u0103pt\u0103m\u00e2ni. \u00cen plus, perioadele s\u0103pt\u0103m\u00e2nale de repaus nu mai pot fi efectuale la bordul autovehiculului, ci \u00een spa\u021bii de cazare, costurile acestora fiind acoperite de c\u0103tre angajatori.<\/p>\n\n\n\n<p>Mai mult, tot din 20 august 2022, implic\u0103 respectarea a dou\u0103 pauze s\u0103pt\u0103m\u00e2nale reduse de 24 de ore consecutive \u00een cazul transporturilor interna\u021bionale, cu amendamentul c\u0103 \u201e<em>\u00een oricare patru s\u0103pt\u0103m\u00e2ni consecutive, acel conduc\u0103tor auto s\u0103 efectueze cel pu\u021bin patru perioade de repaus s\u0103pt\u0103m\u00e2nal dintre care cel pu\u021bin dou\u0103 perioade de repaus s\u0103pt\u0103m\u00e2nal s\u0103 fie perioade de repaus normale<\/em>.\u201d, <strong>conform <a href=\"https:\/\/eur-lex.europa.eu\/\" target=\"_blank\" rel=\"noopener\">eur-lex.europa.eu<\/a><\/strong><\/p>\n\n\n\n<figure class=\"wp-block-gallery has-nested-images columns-default is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\"><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Pachetul de Mobilitate.
