Reglement\u0103rile Pachetului Mobilitate 1 influen\u021beaz\u0103 direct modul \u00een care operezi \u00een spa\u021biul european, iar lipsa de informare poate duce la sanc\u021biuni sau pierderi financiare.<\/p>\n\n\n\n<p>Anul 2022 a adus modific\u0103ri semnificative \u00een ceea ce prive\u0219te <strong>Pachetul de Mobilitate 1<\/strong>, iar noile condi\u021bii impun o adaptare rapid\u0103. Pentru a r\u0103m\u00e2ne competitiv, trebuie s\u0103 urm\u0103re\u0219ti constant evolu\u021bia acestor reglement\u0103ri ale Pachetului Mobilitate 1 \u0219i s\u0103 \u00een\u021belegi impactul lor asupra activit\u0103\u021bii tale zilnice.<\/p>\n\n\n\n<p>Pe m\u0103sur\u0103 ce legisla\u021bia european\u0103 continu\u0103 s\u0103 se schimbe, vor ap\u0103rea noi ajust\u0103ri legate de <strong>Pachetul de Mobilitate 1<\/strong>, motiv pentru care este important s\u0103 fii mereu informat. \u00cen acest articol, \u00ee\u021bi oferim toate datele esen\u021biale pentru a \u00een\u021belege noile <strong>reglement\u0103ri ale Pachetului Mobilitate 1<\/strong> \u0219i modul \u00een care te po\u021bi adapta eficient la ele.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Documente obligatorii la bordul vehiculului<\/strong> &#8211; <strong>Noi reglement\u0103ri ale Pachetului Mobilitate 1<\/strong><\/h2>\n\n\n\n<p>\u00cen contextul noilor <strong>reglement\u0103ri ale Pachetului Mobilitate 1<\/strong>, este esen\u021bial ca fiecare \u0219ofer care efectueaz\u0103 transport rutier interna\u021bional \u00een UE s\u0103 de\u021bin\u0103 la bord toate documentele prev\u0103zute de legisla\u021bie. Lipsa acestora poate duce la amenzi \u0219i re\u021binerea vehiculului de c\u0103tre autorit\u0103\u021bile din statele membre.<\/p>\n\n\n\n<p>Lista documentelor obligatorii la bord:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Contractul de munc\u0103<\/strong> \u2013 \u00eenso\u021bit de o <strong>traducere \u00een limba \u021b\u0103rii tranzitate<\/strong>;<\/li>\n\n\n\n<li><strong>CMR-ul<\/strong> \u2013 documentul de transport interna\u021bional pentru fiecare curs\u0103;<\/li>\n\n\n\n<li><strong>\u0414\u0435\u043a\u043b\u0430\u0440\u0430\u0446\u0438\u044f IMI<\/strong> \u2013 completat\u0103 \u0219i \u00eenregistrat\u0103 \u00een sistemul european de informare;<\/li>\n\n\n\n<li><strong>Atestatul Macron<\/strong> \u2013 acolo unde legisla\u021bia statului respectiv \u00eel solicit\u0103 (ex: Fran\u021ba);<\/li>\n\n\n\n<li><strong>Formularul A1<\/strong> \u2013 care dovede\u0219te plata contribu\u021biilor sociale \u00een \u021bara de origine;<\/li>\n\n\n\n<li><strong>Discurile tahografului (pe h\u00e2rtie)<\/strong> \u2013 pentru perioadele de condus \u0219i repaus;<\/li>\n\n\n\n<li><strong>Documentele personale ale \u0219oferului<\/strong> \u2013 buletin, permis de conducere, <strong>certificate \u0219i atestate profesionale valabile<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Respectarea acestor cerin\u021be este o obliga\u021bie legal\u0103 impus\u0103 de noile reglement\u0103ri ale Pachetului Mobilitate 1 \u0219i asigur\u0103 evitarea sanc\u021biunilor \u00een timpul controalelor transfrontaliere.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Declara\u021biile IMI \u2013 Obligatorii \u00een cadrul noilor reglement\u0103ri ale Pachetului Mobilitate 1<\/strong><\/h2>\n\n\n\n<p>\u00cen conformitate cu noile reglement\u0103ri ale Pachetului Mobilitate 1, completarea <strong>declara\u021biei IMI<\/strong> a devenit o cerin\u021b\u0103 esen\u021bial\u0103 pentru to\u021bi \u0219oferii deta\u0219a\u021bi \u00een spa\u021biul Uniunii Europene.<\/p>\n\n\n\n<p>Aceast\u0103 declara\u021bie trebuie \u00eenregistrat\u0103 <strong>\u00een platforma IMI (Internal Market Information System)<\/strong> cel t\u00e2rziu <strong>p\u00e2n\u0103 la \u00eenceputul perioadei de deta\u0219are<\/strong>, indiferent de durata acesteia.<\/p>\n\n\n\n<p>Scopul principal, conform Comisiei Europene, este de a sprijini func\u021bionarea corect\u0103 a <strong>pie\u021bei unice europene<\/strong>, prin facilitarea cooper\u0103rii administrative \u00eentre statele membre \u0219i prin cre\u0219terea transparen\u021bei \u00een ceea ce prive\u0219te deta\u0219area lucr\u0103torilor.<\/p>\n\n\n\n<p>Prin urmare, fiecare \u0219ofer care efectueaz\u0103 o \u00eenc\u0103rcare sau desc\u0103rcare \u00eentr-un stat membru UE are obliga\u021bia de a fi \u00eenregistrat \u00een IMI, iar declara\u021bia completat\u0103 trebuie s\u0103 se afle la bordul vehiculului, \u00een caz de control. Pentru mai multe informa\u021bii, <a href=\"https:\/\/cargotrack.md\/ru\/detasare-soferi\/\">acceseaz\u0103 acest link.<\/a><\/p>\n\n\n\n<p>Pentru detalii suplimentare \u0219i acces direct la platform\u0103, po\u021bi vizita portalul oficial <a class=\"\" href=\"https:\/\/www.imi.europa.eu\/\" target=\"_blank\" rel=\"noopener\">\u0437\u0434\u0435\u0441\u044c<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Formularul A1 \u2013 Document esen\u021bial \u00een cadrul noilor reglem\u0103nt\u0103ri ale Pachetului Mobilitate 1<\/h3>\n\n\n\n<p>\u00cen contextul noilor <strong>reglement\u0103ri ale Pachetului Mobilitate 1<\/strong>, <strong>formularul A1<\/strong> este unul dintre documentele obligatorii pe care \u0219oferul trebuie s\u0103 le aib\u0103 la bordul vehiculului, \u00een cazul deta\u0219\u0103rilor interna\u021bionale \u00een UE.<\/p>\n\n\n\n<p>Acest formular atest\u0103 faptul c\u0103 \u0219oferul r\u0103m\u00e2ne asigurat \u00een sistemul de securitate social\u0103 al \u021b\u0103rii de origine, chiar dac\u0103 lucreaz\u0103 temporar \u00eentr-un alt stat membru.<\/p>\n\n\n\n<p><strong>Lipsa formularului A1<\/strong> \u00een cazul unui control poate duce la amenzi \u0219i la probleme administrative pentru companie.<\/p>\n\n\n\n<p>De\u0219i ob\u021binerea lui poate presupune timp \u0219i birocra\u021bie, <strong>CargoTrack \u00ee\u021bi ofer\u0103 sprijin \u00een acest proces<\/strong>, astfel \u00eenc\u00e2t tu s\u0103 respec\u021bi toate cerin\u021bele legale f\u0103r\u0103 b\u0103t\u0103i de cap.<\/p>\n\n\n\n<p>Pentru mai multe informa\u021bii despre ob\u021binerea formularului A1 \u0219i suportul oferit, <strong>intr\u0103 <a href=\"https:\/\/cargotrack.md\/ru\/solutii-monitorizare-gps-consultanta-formular-a1\/\">\u0437\u0434\u0435\u0441\u044c<\/a><\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Licen\u021ba de transport 2,5 -3,5<\/strong> <strong>tone<\/strong> &#8211; <strong>Obliga\u021bie impus\u0103 de noile reglem\u0103nt\u0103ri ale Pachetului Mobilitate 1<\/strong><\/h3>\n\n\n\n<p>Una dintre schimb\u0103rile importante aduse de <strong>reglement\u0103rile ale Pachetului Mobilitate 1<\/strong> vizeaz\u0103 operatorii care folosesc vehicule cu masa total\u0103 autorizat\u0103 \u00eentre <strong>2,5 \u0219i 3,5 tone<\/strong>.<\/p>\n\n\n\n<p>Ace\u0219tia sunt acum obliga\u021bi s\u0103 ob\u021bin\u0103 <strong>licen\u021b\u0103 de transport<\/strong>, emis\u0103 de <strong>Autoritatea Rutier\u0103 Rom\u00e2n\u0103 (ARR)<\/strong>, similar cu cerin\u021bele impuse pentru vehiculele de peste 3,5 tone.<\/p>\n\n\n\n<p>Acest pas birocratic a devenit un obstacol pentru unii administratori de flot\u0103, mai ales pentru firmele mici care nu aveau anterior nevoie de aceast\u0103 licen\u021b\u0103.<\/p>\n\n\n\n<p>Pentru a verifica statutul vehiculelor \u0219i datele din <strong>Registrul Electronic Na\u021bional al Operatorilor de Transport<\/strong>, ARR a pus la dispozi\u021bie un portal oficial. Accesul la aceste informa\u021bii necesit\u0103 <strong>crearea unui cont<\/strong> \u0219i <strong>plata unui abonament anual<\/strong> \u00een valoare de <strong>41 RON<\/strong>.<\/p>\n\n\n\n<p>Pentru mai multe detalii privind ob\u021binerea licen\u021bei de transport pentru categoria 2,5 \u2013 3,5 tone, <strong><a href=\"https:\/\/cargotrack.md\/ru\/licenta-transport-2-5-3-5-tone\/\">acceseaz\u0103 acest link<\/a><\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Timpul de condus &#8211; Reguli impuse de noile reglem\u0103nt\u0103ri ale Pachetului Mobilitate 1<\/strong><\/h3>\n\n\n\n<p>Conform <strong>reglement\u0103rilor ale Pachetului Mobilitate 1<\/strong>, timpii de condus au fost clarifica\u021bi \u0219i standardiza\u021bi la nivel european pentru a asigura siguran\u021ba rutier\u0103 \u0219i condi\u021bii echitabile de munc\u0103.<\/p>\n\n\n\n<p>\u0218oferii pot conduce:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>P\u00e2n\u0103 la 9 ore pe zi<\/strong>, cu posibilitatea de <strong>extindere la 10 ore<\/strong>, de cel mult <strong>dou\u0103 ori pe s\u0103pt\u0103m\u00e2n\u0103<\/strong>;<\/li>\n\n\n\n<li><strong>Maximum 56 de ore \u00eentr-o s\u0103pt\u0103m\u00e2n\u0103<\/strong> \u0219i cel mult <strong>90 de ore cumulate \u00een dou\u0103 s\u0103pt\u0103m\u00e2ni consecutive<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>\u00cen situa\u021bii speciale, \u0219oferii pot dep\u0103\u0219i aceste limite cu <strong>1\u20132 ore suplimentare<\/strong>, dac\u0103 este necesar pentru a ajunge acas\u0103 sau la sediul firmei <strong>\u00eenaintea repausului s\u0103pt\u0103m\u00e2nal<\/strong>.<\/p>\n\n\n\n<p><strong>Ce include timpul de lucru al \u0219oferului<\/strong><\/p>\n\n\n\n<p>Timpul de lucru nu \u00eenseamn\u0103 doar condusul efectiv. Sunt incluse \u0219i activit\u0103\u021bi precum:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00cenc\u0103rcarea \u0219i desc\u0103rcarea m\u0103rfurilor;<\/li>\n\n\n\n<li>Asisten\u021ba pasagerilor (\u00een cazul transportului de persoane);<\/li>\n\n\n\n<li>Cur\u0103\u021benie \u0219i \u00eentre\u021binere tehnic\u0103 a vehiculului;<\/li>\n\n\n\n<li>Supravegherea opera\u021biunilor de \u00eenc\u0103rcare;<\/li>\n\n\n\n<li>Completarea actelor \u0219i formalit\u0103\u021bilor administrative.<\/li>\n<\/ul>\n\n\n\n<p><strong>Revenirea la baz\u0103 \u2013 Obliga\u021bie important\u0103<\/strong><\/p>\n\n\n\n<p>Conform noilor reglement\u0103ri ale Pachetului de Mobilitate 1, <strong>cel pu\u021bin o dat\u0103 la fiecare patru s\u0103pt\u0103m\u00e2ni<\/strong>, \u0219oferul trebuie s\u0103 fie readus <strong>la sediul companiei sau la domiciliu<\/strong> pentru a beneficia acolo de <strong>un repaus s\u0103pt\u0103m\u00e2nal complet<\/strong> sau pentru a recupera o perioad\u0103 de repaus redus anterior.<\/p>\n\n\n\n<p>Aceast\u0103 prevedere este menit\u0103 s\u0103 asigure o mai bun\u0103 protec\u021bie social\u0103 a conduc\u0103torilor auto \u0219i este monitorizat\u0103 strict \u00een controalele de pe teritoriul UE.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/cargotrack.md\/wp-content\/uploads\/2022\/10\/pachetul-de-mobilitate-soferi-scaled-1.webp\" alt=\"Noi reglement\u0103ri ale Pachetului Mobilitate 1\" class=\"wp-image-77597\" srcset=\"https:\/\/cargotrack.md\/wp-content\/uploads\/2022\/10\/pachetul-de-mobilitate-soferi-scaled-1.webp 1024w, https:\/\/cargotrack.md\/wp-content\/uploads\/2022\/10\/pachetul-de-mobilitate-soferi-scaled-1-300x200.webp 300w, https:\/\/cargotrack.md\/wp-content\/uploads\/2022\/10\/pachetul-de-mobilitate-soferi-scaled-1-768x512.webp 768w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\">Noi reglement\u0103ri ale Pachetului Mobilitate 1<\/figcaption><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">\u0218oferii care NU intr\u0103 sub inciden\u021ba Directivei deta\u0219\u0103rii \u2013 conform noilor reglement\u0103ri ale Pachetului Mobilitate 1<\/h3>\n\n\n\n<p>Conform <strong>art. 5^3 din Legea nr. 16\/2017<\/strong>, modificat\u0103 prin <strong>Ordonan\u021ba Guvernului nr. 12\/2022<\/strong>, anumite categorii de \u0219oferi sunt <strong>excluse de la aplicarea Directivei privind deta\u0219area transna\u021bional\u0103<\/strong>. Aceste excep\u021bii au fost introduse \u00een contextul <strong>reglement\u0103rilor ale Pachetului Mobilitate 1<\/strong> \u0219i vizeaz\u0103 situa\u021biile \u00een care nu se consider\u0103 c\u0103 \u0219oferul este deta\u0219at, chiar dac\u0103 opereaz\u0103 pe teritoriul altor state membre.<\/p>\n\n\n\n<p><strong>\u0218oferii care NU intr\u0103 sub inciden\u021ba directivei deta\u0219\u0103rii sunt cei care:<\/strong><\/p>\n\n\n\n<p>a) Efectueaz\u0103 <strong>transport rutier bilateral de m\u0103rfuri<\/strong> (din statul de stabilire c\u0103tre alt stat \u0219i invers).<\/p>\n\n\n\n<p>b) Realizeaz\u0103, pe l\u00e2ng\u0103 transportul bilateral, <strong>o activitate suplimentar\u0103 de \u00eenc\u0103rcare \u0219i\/sau desc\u0103rcare<\/strong> \u00een statele membre sau \u021b\u0103ri ter\u021be <strong>pe traseu<\/strong>, at\u00e2ta timp c\u00e2t <strong>nu \u00eencarc\u0103 \u0219i nu descarc\u0103 \u00een acela\u0219i stat membru<\/strong>.<\/p>\n\n\n\n<p>c) Efectueaz\u0103 <strong>maximum dou\u0103 activit\u0103\u021bi suplimentare de \u00eenc\u0103rcare\/desc\u0103rcare<\/strong> \u00een timpul unei curse bilaterale (una \u00een drumul dus \u0219i una \u00een cel de \u00eentoarcere), <strong>cu condi\u021bia<\/strong> s\u0103 nu \u00eencarce\/descarce \u00een acela\u0219i stat \u0219i s\u0103 nu fi efectuat alte activit\u0103\u021bi \u00eenainte.<\/p>\n\n\n\n<p>d) Efectueaz\u0103 <strong>transport rutier bilateral de persoane<\/strong> (autocar\/microbuz).<\/p>\n\n\n\n<p>e) \u00cen cadrul transportului de persoane, realizeaz\u0103 <strong>\u00eembarc\u0103ri sau debarc\u0103ri \u00een tranzit<\/strong>, f\u0103r\u0103 a efectua transport \u00eentre dou\u0103 puncte din acela\u0219i stat membru (f\u0103r\u0103 cabotaj).<\/p>\n\n\n\n<p>f) <strong>Tranziteaz\u0103<\/strong> teritoriul unui stat membru <strong>f\u0103r\u0103 activitate economic\u0103<\/strong> \u2013 adic\u0103 f\u0103r\u0103 \u00eenc\u0103rcare, desc\u0103rcare, \u00eembarcare sau debarcare.<\/p>\n\n\n\n<p>g) <strong>Este implicat doar \u00een segmentul rutier ini\u021bial sau final al unui transport combinat<\/strong> (de exemplu: camion + tren sau camion + nav\u0103), <strong>f\u0103r\u0103 a efectua alte opera\u021biuni de transport \u00een statul membru respectiv.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Salariul minim pentru conduc\u0103torii auto deta\u0219a\u021bi conform noilor reglement\u0103ri ale Pachetului Mobilitate 1<\/h3>\n\n\n\n<p>Una dintre prevederile esen\u021biale din cadrul reglement\u0103rilor Pachetului Mobilitate 1 este legat\u0103 de respectarea <strong>salariului minim<\/strong> al \u021b\u0103rii \u00een care \u0219oferul este deta\u0219at.<\/p>\n\n\n\n<p>Aceast\u0103 m\u0103sur\u0103 vine ca un avantaj pentru \u0219oferi, deoarece le ofer\u0103 <strong>dreptul la o remunera\u021bie echitabil\u0103<\/strong>, \u00een func\u021bie de legisla\u021bia na\u021bional\u0103 a statului \u00een care \u00ee\u0219i desf\u0103\u0219oar\u0103 activitatea temporar.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ce \u00eenseamn\u0103 concret?<\/h3>\n\n\n\n<p>Angajatorul are <strong>obliga\u021bia legal\u0103<\/strong> de a pl\u0103ti \u0219oferului deta\u0219at <strong>cel pu\u021bin salariul minim \u00een vigoare \u00een \u021bara gazd\u0103<\/strong>.<br>Dac\u0103 salariul din acea \u021bar\u0103 este mai mare dec\u00e2t cel oferit \u00een Rom\u00e2nia, trebuie f\u0103cut\u0103 <strong>ajustarea corespunz\u0103toare<\/strong>.<\/p>\n\n\n\n<p>Aceasta nu este o op\u021biune, ci o <strong>obliga\u021bie ferm\u0103<\/strong>, iar nerespectarea poate atrage amenzi \u0219i interdic\u021bii.<\/p>\n\n\n\n<p><strong>\u26a0\ufe0f \u0412\u043d\u0438\u043c\u0430\u043d\u0438\u0435!<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Salariile difer\u0103<\/strong> semnificativ de la o \u021bar\u0103 la alta.<\/li>\n\n\n\n<li>Informa\u021biile privind salariile minime trebuie <strong>verificate individual<\/strong> pentru fiecare stat membru.<\/li>\n\n\n\n<li>Unele \u021b\u0103ri aplic\u0103 \u0219i <strong>suplimente obligatorii<\/strong> (ex: pentru ore de noapte, concediu, weekend etc.), nu doar un salariu minim orar.<\/li>\n<\/ul>\n\n\n\n<p>Prin urmare, este crucial ca fiecare companie de transport s\u0103 fie bine informat\u0103 \u0219i s\u0103 respecte \u00een mod clar aceste <strong>reglement\u0103ri ale Pachetului Mobilitate 1<\/strong> pentru a evita penaliz\u0103rile \u0219i a garanta condi\u021bii corecte de munc\u0103 pentru \u0219oferi.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Tahograful impus \u00een transportul u\u0219or<\/strong><\/h3>\n\n\n\n<p>Un element nou \u0219i dificil pentru mul\u021bi operatori de <strong>transport u\u0219or<\/strong> este <strong>obliga\u021bia de a monta tahograf<\/strong> \u0219i de a respecta <strong>regulile privind timpul de condus \u0219i odihn\u0103<\/strong>, exact ca \u00een cazul transportului greu.<\/p>\n\n\n\n<p>Concret, <strong>\u0219oferii vehiculelor \u00eentre 2,5 \u0219i 3,5 tone<\/strong> (inclusiv autoutilitarele cu remorc\u0103 sau semiremorc\u0103) care efectueaz\u0103 <strong>transport interna\u021bional<\/strong> vor fi <strong>obliga\u021bi<\/strong> s\u0103 se conformeze acelora\u0219i reglement\u0103ri aplicabile camioanelor
